Thank you for choosing Parks to commission your HMO license. This application form will ask you for a series of necessary information in order to process your application.

There are three declarations on behalf of Brighton and Hove City Council which require your signature. This permits Parks to apply/renew for your HMO licence, you are required to sign each declaration where prompted. The first declaration 'Informing People In Writing', requires you to inform persons relating to the property.

Informing People In Writing
As the applicant, you must write to the following people to let them know this application has been made. These people are:
- - Any mortgagee of the property to be licensed;
- - Any owner of the property to which the application relates (if that is not you) i.e. the freeholder and any head lessors who are known to you;
- - Any other person who is a long leaseholder or a tenant (but not a statutory tenant or other tenant whose lease or tenancy is for less than three years (including a periodic tenancy)) This may relate to the property or any part of it (including any flat);
- - The proposed licence holder (if that is not you);
- - The managing agent (if any) (if it is not you);
- - Any person who has agreed that they will be bound by any condition or conditions in a licence if it is granted.
As the applicant, you must tell each of the people:
- - Your name, address, telephone number and e-mail address or fax number (if any).
- - The name, address, telephone number and e-mail address or fax number (if any) of the proposed licence holder (if it will not be you).
- - That this is an application for an HMO licence under Part 2 of the Housing Act 2004.
- - The address of the property to which the application relates.
- - That the application will be made to Brighton & Hove City Council at Private Sector Housing, Room G14, Hove Town Hall, Norton Road, Hove, BN3 3BQ.

Declaration of being a "fit and proper" person
1. I declare that I am a fit and proper person to be accredited. I, nor any person associated or formerly associated with me, have any unspent convictions that are relevant to my application, in particular:
- 1. Any offence involving fraud or other dishonesty, or violence or drugs, or any offence listed in Schedule 3 to the Sexual Offences Act 2003
- 2. Undertaken any unlawful discrimination on grounds of sex, colour, race, ethnic or national origins or disability in, or in connection with, the carrying on of any business;
- 3. Contravened any provision of the law relating to housing or of landlord and tenant law; or
- 4. Been found to have acted otherwise than in accordance with any applicable code of practice approved under section 233.

- 1. Been in control of a property subject to a Control Order under section 379 of the Housing Act 1985.
- 2. Been refused a licence, had a licence removed, or breached conditions of a licence for any property in relation to a mandatory, additional or selective licensing scheme under the Housing Act 2004.
- 3. Been in control of any property that has been subject to an Interim or Final Management Order or a Special Interim Order under the Housing Act 2004.
- 4. Been in control of any property on which a Local Authority has carried out works in default.

Been in control of any property where you have been found guilty of a criminal offence or been the subject of legal proceedings commenced by a Local Authority or other Regulatory Body (such as breaches of the Environmental Protection Act 1990, Planning Control, Compulsory Purchase or Fire Safety Requirements).
- 6. Been convicted of any charges relating to harassment or illegal eviction.

Previous legal action
Consider the following statements in respect of the Proposed Licence Holder and Manager:
- 1. They have one or more unspent convictions, which may be relevant to their fitness to hold a licence or to manage a licensed HMO, in particular, any such conviction in respect of any offence involving fraud or other dishonesty, violence, drugs, or any offence listed in Schedule 3 to the Sexual Offences Act 2003.
- 2. A Court or Tribunal has found that they have practised unlawful discrimination on grounds of sex, colour, race, ethnic or national origin, or disability, in or in connection with the carrying on of any business.
- 3. They have had any judgement made against them in civil or criminal proceedings due to contravention(s) of any provision of any enactment relating to housing, public health, environmental health or landlord and tenant law.
- 4. In the last five years they have owned or managed a property which has been subject to a control order under section 379 of the Housing Act 1985, or any
